§ 7-1. Nuisance odors prohibited; exclusions; penalty.

  • (a)

    Any person, who causes, suffers, allows or permits or fails to take reasonable steps to abate or terminate the emission from any source whatsoever of obnoxious, disagreeable or foul odors which are offensive or cause an annoyance to the public, or which adversely affect the comfort, enjoyment or health of the public including but not limited to those living or owning property in the vicinity shall be deemed to be creating and/or maintaining a nuisance which is hereby declared unlawful.

    (b)

    This section shall specifically exclude, however, agricultural or farming operations as defined in general statutes section 19a-341 as amended.

    (c)

    Any person who violates any provision of this section shall be fined one hundred dollars ($100.00) for each violation, with each day constituting a separate violation in the case of continuing violation. The fine shall be in addition to and not in lieu of injunctive relief which shall be enforced through the issuance of an injunction by a court of competent jurisdiction and any other remedy permitted by law.
